Zahir X Batin is an independent artistic and creative platform presenting and developing multidisciplinary creative work.

5. LIMITED PERSONAL USE
Subject to these Terms, Zahir X Batin grants you a limited, non-exclusive, non-transferable and revocable right to access the Website and view its Content for personal, non-commercial purposes.
This permission does not transfer ownership of any Content to you.
Any commercial, editorial, educational, promotional, reproduction or other use beyond ordinary personal use requires appropriate authorization where required.

6. TRADEMARKS AND BRANDING

Products are subject to availability.
We reserve the right, where permitted by law, to:
Correct errors in product descriptions or pricing;
Limit quantities;
Modify or discontinue products;
Refuse or cancel an order where there is a legitimate reason to do so.
Where an order is cancelled by us after payment has been received, any amount properly refundable to you will be returned using the applicable payment method.
Nothing in these Terms limits any rights you may have under applicable consumer-protection legislation.
8. PRICES AND TAXES
Prices displayed on the Website are stated in Canadian dollars unless otherwise indicated.
Applicable sales taxes and other legally required charges will be presented in accordance with applicable law.
Prices may change without prior notice, but a price change will not alter an order that has already been validly accepted except where permitted or required by law.
9. ORDERS AND PAYMENT

An order confirmation does not necessarily mean that the order has been finally accepted if further verification is required.

10. ONLINE CONTRACTS AND CONSUMER RIGHTS
For purchases made online by consumers in Québec, Zahir X Batin will comply with applicable requirements of the Consumer Protection Act and other applicable legislation.
Where required by law, the consumer will receive a copy of the applicable contract or transaction information in a form that can reasonably be saved and printed.

11. SHIPPING AND DELIVERY
Shipping options, costs and estimated delivery periods will be presented where applicable during the purchasing process.
Delivery estimates are estimates only unless expressly stated otherwise.
Once an order has been accepted, we will take reasonable steps to arrange shipment within the stated or applicable timeframe.
We are not responsible for delays caused by circumstances beyond our reasonable control, including carrier delays, weather, customs, strikes, service interruptions or other circumstances beyond our control.
Where applicable, customers outside Canada are responsible for any customs duties, import charges or other fees imposed by the destination country, unless otherwise stated.
Nothing in this section limits any mandatory consumer rights concerning delivery.
12. RETURNS, EXCHANGES AND REFUNDS
Our return, exchange and refund practices will be communicated clearly for the applicable product or order.
Where a specific return or refund policy applies, that policy forms part of the applicable purchase terms.
Nothing in a Zahir X Batin return policy limits rights provided to consumers under applicable Québec or Canadian law.
If you receive a product that is damaged, defective or materially different from what was ordered, please contact us as soon as reasonably possible with your order information and, where appropriate, photographs documenting the issue.
Certain products may be subject to special conditions, including customized, personalized, limited-edition or otherwise non-standard products, subject always to applicable law.

13. LEGAL WARRANTIES
Products sold to Québec consumers are subject to applicable legal warranties provided by law.
Nothing in these Terms excludes or restricts a legal warranty or other consumer right that cannot legally be excluded or restricted.
Where applicable, consumers retain their rights under the Québec Civil Code and Consumer Protection Act.
14. CREATIVE SERVICES
Zahir X Batin may offer creative services including, depending on availability:
Creative direction;
Photography;
Videography;
Visual production;
Video production;
Editing;
Marketing and promotional content;
Publishing-related services;
Graphic or artistic direction;
Other creative services.
Services may be provided to artists, businesses, organizations, individuals or other clients.
Specific projects may require a separate quotation, proposal, statement of work, service agreement or other written agreement.
Where a separate agreement exists, that agreement will govern the specific project in the event of an inconsistency with these general Terms.
15. CREATIVE PROJECTS, FEES AND DEPOSITS
For creative services, the scope of work, fees, payment schedule, deliverables, deadlines, revisions and licensing arrangements may be established in a separate written agreement.
Unless otherwise agreed in writing:
Work outside the agreed scope may result in additional charges;
Client-requested revisions beyond the agreed number may result in additional charges;
Third-party costs may be charged to the client where previously agreed;
Deposits or advance payments may be required before work begins;
Final deliverables may be provided only after applicable outstanding amounts have been paid.
A quotation or proposal may have an expiry date and may be withdrawn or revised before acceptance.
16. OWNERSHIP AND LICENSING OF CREATIVE WORK
Ownership and usage rights relating to commissioned creative work will depend on the written agreement applicable to the project.
Unless expressly transferred or licensed in writing, intellectual-property rights remain with their respective owner.
Payment for a creative service does not automatically constitute a transfer of copyright or unlimited commercial rights.
A client may receive a licence to use final deliverables for specified purposes, platforms, territories, durations or media, as agreed in writing.
Raw footage, source files, working files, project files, unused concepts and production materials are not automatically included unless expressly agreed.
17. CLIENT MATERIALS
If you provide photographs, logos, music, text, video, artwork, trademarks, documents or other materials to Zahir X Batin
for a project, you represent that you have the necessary rights or permissions to provide and use those materials.
You authorize us to use those materials as reasonably necessary to provide the agreed services.
You remain responsible for obtaining appropriate permissions for third-party materials you provide.
18. PORTFOLIO AND PROMOTIONAL USE
Unless otherwise agreed in writing, Zahir X Batin may identify completed creative work produced by us as part of our portfolio or professional presentation after the work has been publicly released.
Where a project is confidential, subject to a confidentiality agreement, or otherwise restricted from public presentation, we will respect the applicable restrictions.
19. USER-SUBMITTED CONTENT
If the Website allows users to submit comments, reviews, photographs, artwork, writing, videos, testimonials or other material (“User Content”), you retain ownership of your User Content.
By submitting User Content, you grant Zahir X Batin a non-exclusive, royalty-free licence to host, reproduce, display and use that User Content for the purposes for which it was submitted and for operating, promoting and presenting the Website, subject to applicable law and any specific agreement governing the submission.
You represent that:
- You own the User Content or have the necessary rights and permissions to submit it;
- Your submission does not infringe another person’s intellectual-property rights;
- Your submission does not unlawfully disclose another person’s private information;
- Your submission is not fraudulent, defamatory, threatening, discriminatory, obscene or otherwise unlawful;
- Your submission does not contain malicious software or harmful code.
We may remove User Content where we reasonably believe it violates these Terms or applicable law.
20. COMMENTS AND REVIEWS
Where comments or reviews are permitted, they represent the views of their authors and not necessarily those of Zahir X Batin.
You must not submit false, misleading, defamatory, abusive or fraudulent reviews or comments.

We reserve the right to remove content that violates these Terms or applicable law.

In particular, these Terms do not exclude or limit any mandatory consumer rights, legal warranties, liability for fraud, or liability that cannot legally be excluded or limited.
29. INDEMNIFICATION
To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, liabilities and reasonable expenses arising from your unlawful use of the Website, your violation of these Terms, or your infringement of another person’s rights.
This provision does not apply to the extent that the relevant claim results from the negligence, unlawful conduct or other responsibility of Zahir X Batin.
30. FORCE MAJEURE
Zahir X Batin will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including natural disasters, severe weather, war, civil unrest, labour disruptions, government measures, widespread internet or telecommunications failures, major technical failures, transportation disruptions or other events beyond reasonable control.
This provision does not affect mandatory consumer rights.
31. TERMINATION
We may suspend or terminate your access to portions of the Website where reasonably necessary, including where you materially violate these Terms or use the Website unlawfully.
Termination does not affect rights or obligations that arose before termination.
Sections concerning intellectual property, payment obligations, liability, dispute resolution and any other provisions intended by their nature to survive termination will continue to apply.

34. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be interpreted or modified to the extent necessary to make it enforceable where legally permitted.
The remaining provisions will continue to apply.
35. ENTIRE AGREEMENT
These Terms, together with applicable policies, order information, service agreements, quotations and other agreements expressly incorporated into a transaction, constitute the applicable agreement between you and Zahir X Batin concerning the relevant Website use, purchase or service.
Where a specific written agreement applies to a particular creative project, that agreement will govern the project to the extent of any inconsistency.
36. NO WAIVER
A failure by Zahir X Batin to enforce a provision of these Terms does not constitute a waiver of that provision or our right to enforce it later.
